Why Lawyers Should “Unbundle” for Family Court Matters

Over the last eight or so years a new practice in legal assistance has emerged. This practice is known as “unbundling” or “discrete task representation.” Unbundling or discrete task representation is a practice where an attorney may assist a person through the process of representing themselves in court. The attorney and the person decide at the beginning of the relationship what exactly the nature of the services provided will be. These services can be as simple as proofreading documents to as complicated as walking the person almost step by step through the court process, even serving as a back up in court. One large factor of an unbundled relationship is the attorney does NOT represent the client, the attorney does not speak for the client, does not argue in court for the client, the attorney merely guides the client.

Although this practice has been growing over the last decade, it is still very difficult to find an attorney that does offer unbundled services. This is surprising given the increasing number of Family Court litigants who appear in court representing themselves. Management reports from two districts in Wisconsin for the year 1999 showed Pro Se litigants in one district at 72 percent and the other district at 53 percent. These numbers are similar or only slightly higher than districts all over the country.

The question begs to be asked. Why would people choose to represent themselves in Family Court when the stakes are so high?

Court is a time is of the essence situation, people do not necessarily have the time to save a retainer that ranges anywhere from $1500 to $5000 prior to entering the court process. The availability of information about the Family Court process leads some people to believe the process to be simple enough to successfully tackle on their own. People do not trust lawyers. They feel lawyers are only interested in money; the lawyers really don’t care about the litigant’s property rights or their rights to their children.

Each of these examples is a very valid reason for people to not avail themselves of the expertise of an attorney.

Why should lawyers offer unbundled services? The first and probably most important reason to a lawyer trying to pay their bills is some money is better than no money. Assisting Pro Se Family Court litigants can provide valuable cash flow without placing a huge burden on the lawyer’s time. Lawyers need to keep in mind; the nature of the unbundled relationship is negotiated prior to the work starting, once the ground rules are in place, it’s easy for everyone to follow them. Twenty hours per month of unbundled assistance with immediate payment can provide much needed security for an attorney with a client load that pays mostly off of monthly statements, if at all. Unbundled billed hours can also work as a valuable offset to reduced rate hours or pro bono hours.

The second reason lawyers should consider unbundling is because it is just the right thing to do. People in family court are at risk of losing everything that is important to them. Attorney’s have the information these people need. These people are willing to pay for the information. For an attorney to refuse to allow this information to be purchased, at their normal hourly rate, just because the potential unbundled client can’t afford a retainer or wants to be in control of their case, further promotes the negative opinion of attorneys. Providing unbundled services can make an attorney feel just as good as providing pro bono services with the advantage of getting their normal hourly rate.

The third reason for lawyers to provide unbundled services is to contribute to maintaining the integrity and flow of the Family Court system. Even with all the information available to Pro Se litigants it is very easy and common for them to make mistakes. Helping these to avoid these mistakes that have devastating consequences, means they have a better opportunity for a satisfactory outcome. It also minimizes the likelihood that they will have to return to court in a short period of time to clarify items that weren’t handled properly the first time around.

Who Needs “Second Life” If You Can’t Even Manage Your First One?

After recently reading about the on-line gaming craze known as “Second Life,” that’s been gaining popularity, I thought about creating a character for myself. I’d always been a fan of simulation and role playing games so this seemed like a game that would be right down my alley. I started skimming the context of how-to’s the site had to offer. I thought about what name I’d like to have, what type of world I’d like to live in, even what field of work I thought would fulfill my character’s life. All these thoughts and considerations just got me contemplating my own life, or the lack there of.

I began to analyze my life and what was making me tick these days. It was something I honestly hadn’t put much thought into lately. Four months ago I was planning a wedding and a future. Being the Karmicly challenged person I am however, that future was no more. I had once again gone through splits-ville. That special place where every reservation is for a party of one. At first glance, I wanted to point the finger at the latest jilted lover on my list, luckily I took the time to look a little further.

I looked at every failed relationship, every false presumption, every placated blame, and what I came to was one harsh truth. I really was the problem. We’ve all heard the old cliche, “It’s not you, it’s me.” I realized that when you really think about it… it’s true. Whether you’ve cycled through more lovers than your local YMCA has members or it’s just one major screw up, look no further for the reasons than your own bathroom mirror. Seriously, think about this with me for a few moments. There are literally dozens of viable reasons this is true but I’ll stick to the basics for today.

No matter which type of lover you’ve battled with the problem probably lies in your taste. People don’t have strings of bad relationships for no reason. If everyone turns into a nut-job then your basic attractions probably fall back to partners with problems. If you find your prospects have unhealthy tendencies in their relationships with the opposite sexed parent then you might be looking for someone who’s easy to control. Whether these are intentional attractions or you just don’t know any better you still need to realize that the only way to change this is by learning new skills and habits in dating. Unless of course you enjoy your current string of luck, be it good or bad.

All people dating, men and women alike, need to step back, look around, and say to themselves, “Hey I’m sick of losers, so I shouldn’t be a loser either.” That doesn’t mean you need to change who you are, just realize that you need to be looking for someone who’s looking for someone like you. That said, this also means we need to quit living a “Second Life” expecting to impress someone who doesn’t even know if they want the first you, the real you. I mean how can they know, you can’t let them know who that is when you don’t even know who that is. The only way we can do this is by living our first lives.

When you live your first life to the max you simple don’t need a second one. Most likely you won’t have time for a “Second Life” if your real life is fulfilled. I mean who would you be more interested in, the person who’s absolved in some other world or someone living in this existence, who actually still remembers the real world. In a time where so much is controlled by technology don’t let “Life” as we know it become something we play on the computer, instead learn what makes you tick. That way when someone comes along, that could love you and you could love back, your not to busy playing a game to fully appreciate it.

ESL students who want to improve their listening and reading skills can take advantage of several online news resources. These sites help students stay up to date on current events, learn new vocabulary words and become more confident English language users.

Breaking News English

One of my favorite sites for English language news is Breaking News English. This site breaks down news by topic and includes several exercises and activities to help reinforce the vocabulary and concepts taught in the written news stories. The stories are written at a level intermediate to advanced English language students can understand. They include exercises that encourage the student to produce language by writing as well.

Voice of America

Voice of America publishes a Special English website that includes multimedia resources to help English students keep up with current events. Transcripts are available of news stories available in audio files. The audio files are in slower spoken English so ESL students can more easily understand them. The site includes English lessons and activities to accompany them. A WordBook is also available on the site to help students learn new vocabulary. Students can hear new words pronounced and read their definitions as they work through lessons and their activities. The site also has an EFL teaching community in addition to profiles from foreign students studying in the U.S. The site also has information on American idioms.

ESL to Go

ESL to Go is a blog that features stories from CNN’s student website, which has news stories for secondary students. The blog features a video from the student site and asks questions about its content. Readers can watch the videos as many times as necessary to get a good understanding of what it contains. The blog also contains other posts and lessons of interest on a wide range of topics. The ESL to Go blog allows comments as well, so English students can post their thoughts about particular stories they read.

BBC Learning English

BBC’s Learning English is a very detailed site offering a wide range of news, grammar and pronunciation lessons and exercises. It also contains a video series called “The Flatmates,” which contains lessons on a variety of topics. It also contains a student blog and a teacher blog for English teachers. The site also contains video lessons and interactive quizzes to help ESL students learn English. It also includes a pronunciation guide and information on business and general English. The site also contains information about British English slang.

Listening to the news and reading is an active way to practice and improve your English. If you listen to and read at least a few stories every day, you will notice that your English will significantly improve over time. Make a regular habit of practicing your English by keeping up with what is going on in the world.

What is An Energy Star Home All About?

When my husband and I built a cottage last year, we wanted to make the house as energy efficient as possible. We put in extra insulation, wrapped the ducts, sealed the drafts, and installed high quality windows which earned the house an Energy Star rating.

So what exactly is the Energy Star program?

At some point in the past 10 years, you may have purchased a home appliance or lighting fixture and noticed a blue Energy Star on selected merchandise. That blue star is a guide for consumers who are interested in purchasing energy efficient products instead of the usual run-of-the-mill.

The Energy Star program was started in 1992 by the Environmental Protection Agency (EPA) as a way to identify energy efficient products. Computers and monitors were the first products that could earn the rating and in 1995, other categories of office equipment, and heating amp; air conditioning systems were added to the list.

In 1996, the EPA partnered with the U.S. Department of Energy to identify even more product categories. These days, the Energy Star can be found on nearly 50 product lines including home appliances, lighting fixtures, electronics, and more. The Energy Star label also has been extended to include homes and commercial buildings. An Energy Star home means the home was built to a level of energy efficiency that is up to 30% more efficient than more traditional construction.

How does a home qualify?

An Energy Star label doesn’t come automatically. The building contractor must follow a prescribed standard of construction that include certain features that meet the EPA standards for energy efficiency.

If you have ever stepped inside a drafty house, you won’t be surprised to learn that gaps in the construction and improperly installed insulation can increase a home’s utility consumption by 20% or more. Most people only think of leaks happening around doors and windows, but leaks happen any place there are pipes, ductwork, and electrical wiring in a home.

Energy Star homes are those that have a higher degree of insulation and tighter air seals throughout the entire house. Insulation for ceilings must have an R factor of 38; for walls, R-21; and for floors, R-30. In addition to the insulation, all the gaps and holes in the framework must be caulked or filled with expanding foam around wires and pipes, and tightly insulated around the lighting fixtures (especially canned lighting systems), electrical outlets, and the windows. Ducts should fit snugly and be sealed with mastic. Tighter insulation means fewer opportunities for air to escape, fewer drafts, and less noise.

Energy Star homes have superior windows. Higher quality windows are ones with a low U factor of which is a measure of how well the windows keep out the exchange of heat and cold. These windows are 33% more efficient at keeping the warm air inside your home during the winter months. The U factor isn’t all; a low e coating is also desirable. The e coating is what prevents ultraviolet light from entering your home where it can damage the carpet and furniture. These high quality windows also are incredibly efficient at blocking out exterior noise.

Efficient heating and cooling systems are also part of the high performance home checklist. Because these homes are so tightly insulated, the heating and cooling system can be downsized which saves money during construction. Furnaces with a 90% efficiency rating are best and can save significantly on heating costs.

Better windows, better insulation, sealed drafts, and superior furnace system aren’t all it takes to earn that Energy Star rating. Participating building contractors know their homes will be inspected and tested by a third party during the construction process. Home Energy Raters verify that the the exterior of the home has been properly sealed, the insulation installed correctly, and will even run an air pressure test to check that home’s envelope and ducting system are free of air leaks.

The benefits of an Energy Star home are rather amazing. We’ve discovered our cottage is extremely tight and draft free, with consistent temperatures across the entire house. The superior windows and extra insulation also help muffle exterior noise and keep dust and other pollutants outdoors instead of collecting inside. Best of all, the energy consumption is amazingly low which is not only good for the environment, but good for our budget as well.

What Causes Osteoporosis

Osteoporosis is the thinning of the bones which occurs usually after the age of forty. As the years go on, the bones become thinner and thinner. Many people think that only women get osteoporosis. This is not true. Men, also experience the thinning of the bones, but women are more at risk for this skeletal loss.

Bone loss is common in women after menopause. The reason for this is that after menopause, there is a decrease in the production of estrogen which keeps the bones from getting thinner. Sometimes certain diseases can increase the likelihood of osteoporosis. Among them are thyroid conditions, liver diseases, and alcoholism.

Because osteoporosis causes the bones to become thinner, a person is subjected to hip, spine, and wrist fractures. This usually happens after the age of sixty-five. Many women fall because of the weakness in the bones. Because of this problem, it is important to take a bone scan soon after menopause to find out if there is bone loss, and if so, to what degree.

In order to keep the bones from getting thinner, it is important to exercise, eat a good portion of food that contain calcium and an intake of vitamin D. A small amount of exposure to the sun is a good way to get vitamin D. It is better to take these vitamins from food, but if it is too difficult, then calcium supplements should be taken.

A good way to get calcium is from milk, cottage cheese, and American cheese. Poor diets and a lack of exposure to sunshine can contribute to a loss of vitamin D which is important for calcium to be absorbed in the body.

Exercise is very important in preventing bone loss. A walk at least three times a week for a half an hour is commonly suggested. Also recommended are weight bearing exercises. Bowling is considered to be a good weight bearing exercise. If you have weights such as dumbbells, use them. Just make sure that the weights are not too heavy. You can use heavier weights when you are ready for them. A set of aerobic exercises three times a week is also good.

Sometimes a person is unable to walk for other health reasons, and therefore is unable to exercise. If this is so, physical therapy can help. Also a physical therapist or some other exercise expert can recommend weight lifting exercises where a person just has to sit in a chair.

It is wise to take a bone scan about every two or three years, even if tests have shown that there is no bone loss. This is usually recommended by doctors in order to get an indication as to whether a person who has osteoporosis is remaining the same or getting worse. If a test shows that there is more thinning of the bones, a doctor may prescribe medication.

What 2019 Taught Me

In July of 2019 I set a goal for myself: lose 100 pounds in a year. Sounds a little crazy, yes, but in 6 months I have lost 87 pounds. Once I reach that goal I’m going to continue losing until I’m a healthy weight.
Losing weight is really trial and error. What works for me may not work for you. You have to have willpower and that’s one thing I never had until July 2010. I woke up one morning and decided that it’s now or never and I haven’t looked back since.

I don’t claim to be a weight loss expert or a health care professional. I’m just a single mama from the South who swore off soft drinks and fried foods. (Gasp! That’s blasphemy here in the south) I only drink water and my foods are either baked, broiled or boiled. I’m still learning as I go. The biggest thing, I believe, that’s helped me is using an online food diary that calculates the calories I take in as well as the ones that I burn through exercise.

Here are 10 things that I learned in 2010 that will hopefully help you too.

Only YOU are responsible for your actions, habits, words, etc. It’s so easy to put the blame on someone else but when all is said and done you’re the only person that is reflected in your “life’s mirror”. You don’t have to put butter on everything. Excuses are only excuses and only sound good or reasonable to you. “Can’t” should be struck from your vocabulary because it equals “won’t”. Soda isn’t a necessity. It’s a crutch that contains the drug caffeine. Caffeine is what keeps you addicted to it and it’s just bad for your blood sugar, heart and kidneys. Water CAN and DOES help your diet (aka lifestyle change). I had a friend tell me that their doctor said that water helping your diet is a myth. Hello! Water has NO calories or caffeine. If you’re drinking it with meals and throughout the day you’re not filling yourself with empty calories the way soda does. Exercise is fun and necessary. If you’re not moving, you’re gaining.

You can’t expect to lose weigh without breaking a sweat. You have to MOVE. I’ve learned that just because someone says they’re your friend doesn’t make them a real friend. If they’re not a positive influence in your life, you don’t need them. They’re like empty calories. Wheat isn’t a bad thing. IF I eat pasta, it’s wheat pasta and if I eat bread it’s Nature’s Own 12 Grain bread. I’m doing this lifestyle change for the right reasons: my 3 children. I can already tell that I’m not as tired when I play with them. I have more energy to play with them and it’s a lot easier to get up and down from the floor when we’re playing trains, cars, Power Rangers or whatever. I’ve learned that I can do this. I am stronger than whatever gets thrown my way. And so are you!

This British online store has just opened an actual store here in the United States a couple of months ago. Because their viewpoint is across the pond and because we Americans love everything British, their sense of appeal for mens’ fashion is extraordinary. From bold colors to classic cuts and fine trimmed wear, their range is spectacular for creating an outfit that’s old yet young, fun yet conservative, a perfect blend of all. Though I’ve only found out about them within the year, their content always puts a smile on my face and motivates me to do financially better in life in order to purchase their great merchandise!

2. Design Within Reach

Design Within Reach has all of the classic and modern furniture pieces that have made interior design culture fantastic. You may have have seen many of these pieces in movies and TV, as they constantly use the furniture of Eames, Philippe Starck, Arne Jacobsen, and many more. Design Within Reach has kept the standard for manufacturing the original designs and is the number one source for showcasing these pieces in one of their showrooms. Design Within Reach is exactly what it says in it’s name, great design is within reach for you.

3. Ben Sherman

Another great English design resource, as you can tell I love the quirky and fun styles that come out from a few select designers in the UK! Ben Sherman is spectacular at his finesse in using pattern, color, and texture to create elegant pieces that you love to put on yourself. Since my growing interest last year, I own at least 3 pieces from Ben Sherman including a great brown and beige argyle vest, and dark blue and light blue slight v-neck sweater, a checkered white and blue shirt which I wear every 3 days, no lie! Every time I put one of his creations on, people complement me left and right. Although I know I accept the complement and smile for choosing my selection, the real props goes to Ben Sherman for being fearless and strong in taking what’s in his mind and turning that into action for a fan like me to wear.

I hope you decide to check these out as I’m sure that products from here will give you a different viewpoint, even if you don’t end up wearing or sitting in them. To educate yourself about healthy foods, spend some time on research. While the USDA pyramid is one place to find good information about healthy foods, you may find the Harvard School of Public Health more credible. The Harvard School of Public Health compiles information solely from a scientific perspective. Political trends and lobbyists can color the USDA’s recommendations.

Many people worry about drinking enough water. Because studies dispute the recommended daily intake, you should simply drink when you are thirsty. Water is favorable because it has no calories and rehydrates your body better than any other liquid. Some believe that it also helps you lose weight, but there is no logical or proven connection with this assumption.

Exercise

The final weapon in weight loss is exercise. While understanding the mind-body connection and proper nutrition account for 90% of your program, exercise will boost your success and reduce the time it takes you to achieve your goal.

The mind-body connection plays an important role in your exercise program. While the body loves exercise, the mind often becomes bored, making exercise unenjoyable and therefore unsustainable. To create a long-term program, you must find exercises that keep both your mind and body engaged. Try playing a portable video game, or maybe reading, while you ride a stationary bike. You might like to walk a treadmill while watching your favorite television shows. Yoga is another effective way to entertain the mind while strengthening the body. Until you find the exercise that stimulates both your mind and body, keep trying something new.
